Nextel Cup driver convicted of DWI
NASCAR officials are withholding comment on Nextel Cup rookie Scott Wimmer's conviction on drunk driving charges from a Jan. 31 arrest in High Point.
Following a bench trial Tuesday in High Point, Wimmer, 28, was convicted of driving while impaired. He was given a 60-day suspended sentence, 24 hours of community service, fined $100 plus court costs and must relinquish his driver's license.
Wimmer is appealing his conviction, his attorney said in court.
Wimmer was arrested Jan. 31 after wrecking a pickup truck. His blood alcohol content reportedly was nearly twice N.C.'s .08 limit.
Wimmer's wife, Jody Ambrose, was charged with misdemeanor obstruction and delay in the incident. Ambrose, however, was found not guilty of that charge on Tuesday. A driver's license is not a requirement to compete in NASCAR. Competitors must have a NASCAR license.

From NASCAR.com : The court heard Wimmer's case and found him guilty of driving under the influence. The verdict resulted in a level five conviction, the lowest conviction for such charges. Wimmer will serve 24 hours of community service in a 30-day period. He must also undergo an alcoholic assessment, which he has already completed. Wimmer's conviction will not result in a loss of license.
